Application for Approval to Establish a New Industrial Facility

Service Description

  • This service enables organizations and companies in the business sector to obtain approval to establish a new industrial facility.

Eligibility or Criteria

  • The project owner should be a member of the Kuwait Chamber of Commerce and Industry, and this is required for The companies or individuals who have projects in progress.

  • The applicant must undertake that the product meets the specifications and standards set by the laws and regulations issued in this regard.

  • The applicant must comply with all requirements set by the competent government agencies to preserve the environment and public order.

  • The required fees must be paid.

  • The applicant must be at least 21 years old.

  • The investor’s capital must be greater than two hundred and fifty thousand Kuwaiti dinars.

  • The applicant must be from the following categories: Kuwaitis, individuals and companies established in accordance with the provisions of the Commercial Companies Law , Citizens and companies from the GCC countries, in accordance with the applicable agreements

  • The required activity must not be suspended.

  • The approval of the Ministry of Information and the Ministry of Interior is needed if the required activity includes printing work.

  • The approval of the Environment Public Authority is required.

Required Documents

  • Application for an economic feasibility study
  • Engineering and technical plan of the project (approved by the machinery supplier company or in the name of the investor)
  • Copy of the company’s memorandum of association and any amendments made to such memorandum, if the applicant is a a company, having the required activity within the company’s purposes
  • Original catalogues of machinery and equipment and original quotations for machinery and raw materials in the name of the investor)
  • Note: In case of developed areas, the required documents are as follows:
  • Contract of the concerned party with the developer company
  • Latest rent receipt
  • Civil number
  • Letter from the developer

1 - The investor submits an application for approval to establish an industrial project, attaching the project’s basic data and technical study.
- The Ministry of Commerce and Industry (Companies Department) is contacted.
- All documents and required papers are received.
- Ensure that the investor has no serious violations and that the proposed activity is not under suspension.
- A receipt containing the transaction number and proof of fee payment is provided to the concerned party.
- The Ministry of Information and the Ministry of Interior are contacted if the activity involves printing work.
- An electronic file is prepared and sent to the Feasibility Evaluation Department and the department responsible for developed areas.

Head of the Department for Developed Areas Note: If the industrial facility is located within the developed areas, the developing company must approve the facility’s activity before conducting the feasibility study.

In case any new decisions issued by the Supreme Council for the Environment or the Council of Ministers contradict any opinion issued by the Environment Public Authority regarding approved localization areas, such opinion shall be considered null and void, and the Public Authority for Industry shall be notified of the updates.
